Is it illegal to share 10.6.5 beta release?

Is it illegal to share 10.6.5 Beta? I assume it probably is but I'd like confirmation, the thing is 10.6.5 will be available for free at some point, so I was wondering if sharing the beta release illegal?

It is against the EULA that you must agree before installation, thus it is a copyright violation.

yes it is, I'm pretty sure that you had to agree to an EULA that prohibits you from sharing it, and as a developer you also probably signed an NDA that also would keep you from distributing it.
