Mine doesn't act like it's being throttled; it's still delivering the goods on Geekbench, and with Aperture, Photos and Photoshop. Where it's noticeably deficient compared to the current MacBook Pro model is in running hot and not getting such good battery life despite having a much bigger batter.

Besides Apple has to realize they'd be more likely to be caught doing this in MacOS, no?
 
My guess would be that it's either placebo (i.e you've either become used to it's speed or then you've seen faster newer machines so your old machine feels slower by comparison) or then you haven't cleaned the dust out during it's lifespan so it is throttling itself due to not being able to cool itself properly.
