I've got a MacBook 09 with mavericks and all was brilliant up until today.

For no reason at all today the laptop locked up with the beach ball. After many restarts and shut downs it takes 2 or 3 times longer to get to the logon screen. It will not now load past the logon screen and will just sit there with a beach ball for hours.

In disk utility the verify disk is fine.

I cannot format the partition because it says it is in use.

I'm now restoring from the TM and that is taking many more hours longer than what it usually does.

Could the HDD be on the way out?

If you've got a 5 year old machine it certainly could be, and if it hasn't failed it's going to.

Not sure if that's your issue but I'd replace it now while you still can, a clean OS install on a new HD should hopefully solve most of your probs.
