Is a touchy legal subject in the US so most likely Apple isn't going to allow it anytime soon.

Recording a phone call is not allowed by Apple at this time.

There is simply no way of doing it using the official SDK so there is nothing in the app store. I imagine there may be a way on jailbroken phones...

I think apps go into suspend mode when you get a phone call, which would probably make it impossible for an app to record anything even if the app records audio!

You can reopen an app by going into speaker mode then back to the springboard, my app Escape Pod does that. However, you cannot access the microphone while the phone application is open as it retains unique control over it.
