If you updated to 3.1.3 then you can restore to your default firmware (3.1.2) and jailbreak that. But if your ipod touch came in 3.1.3 as default, then you're going to have to wait until spring, or whenever they release a program.

Even if his iPod came with 3.1.2, if he didn't jailbreak on 3.1.2 before 3.1.3 was released and upload his SHSH to Saurik's server, he has no way to downgrade to 3.1.2.
