Hi I am new and need help jailbreaking my iPhone 3gs 3.1.3. It has 05.12.01 modem firmware.can anyone tell me what program I use to jailbreak it. I have a 2nd gen itouch that I jailbroke and it seemed to run slower than before. If I jailbreak my iPhone 3gs will it become slower?

Jailbreaking does not slow down your phone at all. There are jailbreak applications which can significantly slow your phone, but jailbreaking by itself simply cannot. Chief among these is Winterboard. Just be careful what sort of apps you install that will run in the background and you'll be fine.
With spirit you won't have to worry about that.
On another note, I saw your question about slowing down the iPhone. I read somewhere a few years back that using an old backup to get your data,songs,notes, etc back will slow the phone down and drain your battery - more so for the battery. I can't confirm this, but I've always set my iphones up as new iphones rather than 'restoring' from a backup once the jb was complete.
If you update without selecting a new firmware, iTunes will take you to 4.0.
I'd certainly backup your iphone before hand.
What are you meaning by 'restore'?
Also, spirit is a userland jb - meaning it will do it on the iPhone for you vs. using the pwnage tool method where you create a custom firmware and use iTunes to load it onto the phone.
A couple of helpful hints for you with your planned jailbreak.
1. Do not use Itunes version 9.2 if you are going to use Spirit. Downgrade to version 9.1.1 or earlier. You can google for those versions. The Dev team have reported a problem with 9.2 and Spirit.
2. Do not upgrade to IOS4, This will break your Jailbreak and you will have to wait for the new version of spirit.
3. Back up our SHSH Blobs. While it is too late for 3.1.3 a backup now will save the version apple is currently signing IOS4 SHSH and you may need this in the future.
4. Backing up your Iphone on Itunes is always a good idea before the JB.

Yes, you can still JB the way it is now. No you will not be able to restore it to 3.1.3 again if needed or anything but the latest firmware unlesss you have SHSH's saved for that particular built number.

And without SHSH's on file you will not be able to restore to 3.1.3 anyway. You'd be stuck restoring to 4.0.1
You don't have to put the phone in recovery mode. Connect it to your comptuer sync and backup with itunes, then close itunes and run Spirit. The reason for not using Itunes 9.2 is because the person who developed Spirit says there is a problem with 9.2 and advised not to use it.
