http://blog.iphone-dev.org/post/50363303/u-cant-touch-this, they just need to find a proper way for the community to jailbreak, theres been suggestions of a hardware mod but they are also looking into software exploit.

in this blog post a week ago they mention they were going to try some hardware based mods: http://blog.iphone-dev.org/post/51840602/timber

so yes they have figured something out but not a jailbreak process for everyone to use yet.

And there is no jailbreak available for the iPod Touch 2nd Generation yet. The developers who produce the jailbreaks are working as hard as they can on it, though. I hope to see a working product by the end of October.

It doesn't have custom themes yet and thats main reason to jailbreak for me, I hate the boring home screen and icons

2.1 does have themes, the 2nd gen iPod Touch doesn't because it's not been jailbroken yet

I highlighted in bold to help see ^^, you didn't say can't, you said don't. Two completely different meaning. With don't, your saying when jailbreaking is available, don't do it, but with can't, its saying its you can't jailbreak it but when it can you should.
