Hello,
I currently have an Ipod Touch 3rd Generation currently running ios 4.0
I haven't used it in a while and its not running terribly well because I havent updated in a while.
Will I be able to just update it still jailbroken to newest firmware without restoring it.

Or will i need to restore it, upgrade then jailbreak again?

P.S I haven't updated in a while because I couldn't be bothered restoring it then updating again and then waiting for a jailbreak.

You have to restore to stock iOS, then rejailbreak it. The only firmware Apple seems to sign is iOS 4.3.5 and iOS 4.1, which is why I cannot recommend you to attempt to install iOS 4.3.3 (which is the last iOS which can be jailbroken untethered). iOS 4.3.5 will have a tethered jailbreak. I suggest restoring to iOS 4.1 if you wish to update, but still jailbreak untethered.
