I called my local Target store to see if they will be carrying the 5S on Friday in the hopes that lines at Target may be shorter. They said that they WILL be carrying the phone but they "already have a waiting list".

Isn't this against pretty much every regulation that Apple lays out for selling their products?

No

Apple is not doing pre-orders, carriers and retailers are free to do what they want but Target's waiting list is just that, a waiting list and they're not even sure what inventory they will get.

Come friday Target may have 30 people on a waiting list and only get an inventory of 5 devices, target is not promising you a phone but as they come in you will get a phone eventually.
