Looks like Apple's quest to gain music label approval was a waste of time/money

Not really. Nothing about this judgement would have allowed Apple to give out higher quality files than the user uploaded, and the user still has to upload the file under this judgement - given ADSL is asymetrical, that would take me four weeks for my iTunes library, and I know people with much bigger ones.
