Can I setup a new iPod touch using my iPhone backup?

I lost my iPhone 4... find my phone was useless as I suspect the SIM was removed by the new 'owner' almost immediately.

With the iPhone 5 probably coming out in six months or so I am thinking of just restoring my iPhone backup to an iPod touch. Is this possible?

I...think so, but I'm not sure what it will do to SMS messages / call logs / other "phone" only application data.

Nope. You can only using backups pertaining to the specific device. So you can't use an iPhone backup on an iPod or vice versa.

if he had another iphone would it work or does it have to be same exact phone?

Works across phones, I went from 3G to 4, traded some back ups on my 3G, 4 got stolen so I went back to my 2G, then back to a 4 when I got a replacement. I guess I was under the impression that you could load a iPod Touch backup onto an iPhone but I guess not.
