Mac App Store not in Time Machine Backup

Just put a new HDD in my Macbook as the last failed, migrated my settings from time machine and everything worked fine except no app store nor the apps i downloaded. Just a ? on the dock where the Mac App Store was and a X on the Apps i downloaded from it, Except Twitter for some reason.

I cant re download the Mac App store as its not in my system updates like its says on Apples site?

Have you run software update and updated to the latest version of 10.6 yet? The Mac App store will be included with that update.

Yeah, the Mac App Store was included as part of the 10.6.6 update to Snow Leopard. Unless you are updated to either 10.6.6 or later, the MAS will not be there, and I'm pretty sure it never shows as a separate install in Software Update.

Thanks guys that worked. How come Time Machine doesn't remember what version you were on?
