WHITE PLAINS, New York (AP) -- A man who was fired by IBM for visiting an adult chat room at work is suing the company for $5 million, claiming he is an Internet addict who deserves treatment and sympathy rather than dismissal.

James Pacenza, 58, of Montgomery, says he visits chat rooms to treat traumatic stress incurred in 1969 when he saw his best friend killed during an Army patrol in Vietnam.

In papers filed in federal court in White Plains, Pacenza said the stress caused him to become "a sex addict, and with the development of the Internet, an Internet addict." He claimed protection under the American with Disabilities Act.

That's ridiculous. Seeing your mate killed in Vietnam has nothing to do with trying to pick up tarts off the internet.

someone lands on your house, you get $500. You land on someone elses house, you give them $500. except in the real world, you have lawyers costs, time wasted, etc.

A bit of commonsense wouldn't go astray. If you look at porn at work, you deserve to be fired (unless you're paid to look at porn at work:p)
 
The lawsuit is crap. The guy should get nothing except an extended beating around the face and head for wasting everyone's time and money with this nonsense.

I can't say I'm too terribly surprised though - the whole litagious nature of American society has convinced folks that they aren't ever responsible for anything they do. Do something wrong? Blame someone else and sue 'em! It's your Constitutional right!
 
Getting fired for innocent web surfing? Silly.

Getting fired for an adult chatroom? Fair. It's not a popup, it's deliberate. He shouldn't have been doing it from work.

Suing and claiming web addiction as a disability? Ridiculous.

Only in America. And $5 million? Are you KIDDING me?
 
I get sick when people start abusing the American with Disabilities Act. It abusing a law that had great intention and everything and now people will use it to get out of anything. It makes me sick.

I have a legitimate disability (delexia) that is protected of the Act and I hardly ever use the rights given to me by that act (only thing I really ever use it for is to make sure I have computer access for anything I need to write up and that the first times I choose to use it)

People that this guy make a good law get destroyed, twisted and made unusable. I hope he loses his case and has to pay out the rear in lawyer fees. Also why the hell to some lawyers even take this cases. Do they have no ethics left in them.
 
Like I said earlier the only thing this guy desirves is a severe beating. I am so damn sick of people like him cheating the system and claiming lame disabilities. I have realitives who are disabled and they still fully function in society. And they have NEVER claimed anything from the disabilities act!

I know the feeling; I've got Asperger's syndrome, I virtually never use any of the rights I have except to be allowed to be able to use a computer on tests at school because I really, really suck at writing with a pencil.

If he did have an addiction, he should have spoken to his employers about it and get it recognised that it is real. He should not get a penny and pay their legal fees if he goes through with it. If it happened in 1969, he should get some help and not let it get to this level. Muppet
 
If we eliminated lawsuits I swear the world would be a better place... at least the stupid ones where people only want money and don't truely have an issue.

Like people suing MacDonalds for making them fat. Did they not think to eat somewhere else?? It isnt MaccyD's fault for serving the people
 
this stupid law suits would be cut down a lot if the loser always had to pay the winner legal fees. Instead the defended has to pay their own legal fees no matter what and if they lose they all have to pay the other guys legal fees.

Now I think if you sue some one and lose you should pay for their legal fees they took defending their case. It would cut down on stupid lawsuits like this. The guy have very little to lose and a lot to gain. Now if he loss I think she should pay for IMB legal fees and in doing that it would increase the risk to him.

Well, if you aren't in treatment -- or willing to immediately start treatment -- you should be fired.
