Mid 2009 MacBook Pro Harddrive Replacement

My original harddrive croaked and I am replacing it with a 500 GB Hitachi Z5K500 5400rpm 2.5"

Just a few questions:

- Will I need to format the drive in any way or do I just plug it in and install OSX.

- Will I need a disk/drive copy of Mountain Lion or does my 2009 model Mac have the capability of syncing with Apples servers to download the OS?
