I have a small spider web crack on my iphone screen, i just noticed it today when I was using my phone outside. I have a new 17PM arriving Friday and will have to send my old phone back. Will I get penalized if I don't fix the screen? I have Apple care and have an appt to get it fixed, but if I can avoid paying the $29, I certainly would prefer to avoid it.

I don’t know for sure, but I THINK I understood that if the trade in (IUP or regular trade in?) decides it’s not up to snuff, they just charge you the $29. I just can’t remember how I know that.
But I have the same question. The USB C connection on a family member’s phone is loose, not holding the cable. I don’t know if I should get that fixed or not.

Back in the day, AT&T declined trade-in of my brother’s iPhone 6+ because of a teeny tiny crack in the corner.

I would get it fixed to be safe.

I am not a member of the IUP but did they ask you the condition of your trade in when you were ordering your new iPhone 17. If they did not ask you the condition or specify what is acceptable and what is not then I would not imagine that you would be penalized. On the other hand if they described dents, dings and noticeable cracks at a lesser trade in value than I would say you probably will be penalized.

The original offer required phones in good condition. AT&T later changed it to match Verizon's trade in deal (any condition). I'm not sure which terms and conditions AT&T will honor in case one pre-ordered a phone before they changed the terms.

Since the T & C are not printed on any material or included in any materials sent to the customer, the web links are to official offer.

There is only a link to the "Current" offer details. AT&T is good with legal but this is not a hill they want to die on. All the carriers tend to adjust their based on the deals that the other 2 members of the big 3 try. So far this year has been one of the biggest deals.

AT&T has had issues in the past with similar types of offers. Over the years they have offered full trade-ins on older devices that were not included in the initial Offer on Day 1.
