The thread title pretty much lays it out right there. I tried the sudo killall Dock but it didn't work. Any suggestions?
 
Not to sound condescending, but did you try a restart then try to empty the trash?
 
Try

sudo rm -rf ~/.Trash

Warning: this is one of the most dangerous commands in *nix, so don't mistype it or bad things can happen. You have been warned.
