Raised this concern a few months ago that it's stealthy to hide default data collection during initial MacOS setup behind Express Set Up in Customize Settings on both Big Sur <=11.6.8 and Monterey <=12.5 that would go unnoticed since most would just click Continue. Happy to report that in Monterey 12.6 the data collection screen (second image below) is front and center without hiding behind Express Set Up so Apple is taking notes. Need to also confirm Big Sur 11.7 unless someone can kindly do so.
