mouse gets stuck - not pysically - but on screen

so i have a 2008 unibody macbook and the mouse is constantly "stuck" in the clicked position. The physical button is fine, but as i am moving the mouse around, it behaves as though the mouse is in left click mode. It doesnt happen all the time but it is happening with increasing frequency... what can i do to fix this?

Get a new mouse.

it seems to be more of a software issue. im using my trackpad. it does the same thing with the magic mouse as well.
