LOL Microsoft can't even stick with original name of their OS. They have drop so many features and now also the name. And they wont to produce a reliable OS when they can't eve keep their word. :D
 
I have to admit that I enjoy any trouble Microsoft might encounter, but this is very similar to a certain Tiger case less than three months ago, isn't it...? So this sounds like another bull...pooh lawsuit, and the fact that it's directed towards Microsoft doesn't make it any more right... a bit more amusing, maybe, but not right... ;)

I did think about that when I was posting this but there were differences there. Tiger Direct was a PC manufacturer who tried to get an injunction days before Apple's Tiger OS was released not when Apple started selling a Tiger branded computer. This is a software company (based in the same town) who make systems for businesses, trade under the Vista name and who are considering whether it affects them immediately after the announcement.
 
Nah... I'm still not convinced that this is anything but an overeager lawyer on a gold digging settlement mission... but I'm aware of the differences, and I did say it was similar, not identical, to the Tiger direct case, just in case... ;)
 
The likely candidates to sue:

VISTA - Volunteers In Service To America

VISTA - Makers of Genomic Tools
 
Remember apple is being sued over the same thing right now. The blatantly violated a contract they had with Apple Corps.

I think they will both settle but the plaintiffs are both right.

i think you are seeing this the wrong way.

MS needs to get the name out and familiar with people.
I wouldn't be surprised if they looked for a small enough company that would sue them but that was easy enough just to buy out.

they'll get a lot of press coverage from this and eventually they will settle, but the name will stick with costumers: ".... blahblahblah Vista software company and Vista, the NEXT generation OS from Microsoft... blahblahblah ...."

come on, a REDMOND company?

They should (once again) take a page out of Apple's book and name it and upcomming iterations after an animal. Since the cat family is already taken, I humbly suggest that they go with fish. For example, Windows Flounder, Windows Chub, Windows Anchovy, and so on. It would certainly keep them out of legal hot water, as well as boosting their profile in countries with a fish based diet. It really can't go wrong.

I'd say the biggest difference is the timing of the lawsuit. Not giving a company sufficient time (submarine style) will most likely prejudice a "on the edge" style lawsuit.

But I'd say that the other company might have a difficult time on this one

Uh oh :p OS 9. Is that gunna work against their law suit, if and when they get one :p.

Microsoft will probably just buy the company out!
 
Please correct me if I am wrong, but this is not like the Tiger Direct / Apple lawsuit. The difference is that Tiger Direct sells computer stuff, Tiger OS X is an operating system while Vista makes software and so does Microsoft.
