My brother and I both have early '08 macbook pros with Leopard and I was thinking about buying Snow Leopard. So I was wondering if I bought it, would my brother also be able to use it and update his too?
oops, double post

Technically, yes. It will work. OS X does not "phone home" a la Windows.

However:

SOFTWARE LICENSE AGREEMENT FOR MAC OS X
Single Use, Family Pack and Leopard Upgrade Licenses for use on Apple-branded Systems
.
C. Leopard Upgrade Licenses. If you have purchased an Upgrade for Mac OS X Leopard license, then subject to the terms and conditions of this License, you are granted a limited non-exclusive license to install, use and run one (1) copy of the Apple Software on a single Apple-branded computer as long as that computer has a properly licensed copy of Mac OS X Leopard already installed on it.
From http://images.apple.com/legal/sla/docs/macosx106.pdf

It is less than 100% pure/clean/ethical, as per Apple's definition(s).
