iPhone my first (used) iOS8 device - not in my account

I have purchased a used iPhone without a sim card.
I had a spare sim from my old phone and I setup the phone as new and tested camera, sound, etc.

Mind you this is first time I'm holding iOS8 device.
Since this is a backup unit I did not use it much...

I logged into iCloud today and I see this unit is not showing up in my list.


I did some googling but I am unsure.
Does the seller need to login to iCloud, wipe the device, then uncheck from their iCloud?

iPhone 4S is not stolen. I was able to setup as new device and sign into iCloud and connect to wifi hotspot off of my phone.
