I have an iPod touch 3G that I bought in December 2009 and a few days ago the battery stopped working: it went from 100% to 0% in an hour of music playback.

I was going to get a replacement from Apple; however, if the iPod touch 4G is released before my warranty runs out will Apple give me a 4G replacement or a 3G replacement?

So, for example, if the new itouches are sold in September (three months before my warranty runs out) will Apple give me a replacement 3G or 4g?

Sorry for repeating myself twice it didn't make sense in my head, hopefully it does in yours.

Nope, they'll probably still have hundreds of 3G iPod touches that they will be more than happy to get rid of.

They might just try a restore or replace the battery. They wont give you a 4G... but if you get a new one you can sell it, and use the money for a 4G.
