Is this from the App Store?

Sounds like the app is running in the background.

When you downloaded the app, did you drag it to the Applications folder to install it? Or are you just running it from your Downloads folder or somewhere else? It needs to be in the Applications folder (and run from there) for it to have the right permissions and the update to work properly.

I've no idea, got it for a long time but never thought of updating. How do I check where it runs?
 
Where is your app icon, or how are you opening the app now? If it's in the Dock, right-click the app icon > Options > Show in Finder...that will show what folder it's in. If it's not in Applications, then drag the app to the Applications folder.
 
Safe boot.
Look in your ~/Library/Application Support
As well as ~/Applications (user, not system)
Redownload a fresh copy to install
 
I run Ice. There isn't a dock item. But, I suspect @BigBlur nailed it. You probably have the application sitting in your downloads folder. You originally ran it from there and set it to start automatically and never had to manually run it again. You should exit Ice and move the application into your Application folder.

It was in my Downloads folder, thanks.

I was drunk yesterday. :p
