So, my dad has an upgrade coming up on February 1st. He's using an iPhone 3GS but has no issue with it and doesn't want to upgrade. He told me that he might use his upgrade to get an iPhone 5 and give it to me. We're both on AT&T but I'm on a seperate plan with my mom. I'm using an iPhone 4S. What I need some advice or help with is, how can him and I get it so he can use his upgrade but keep his phone number and such on the sim card in his 3GS and how i can get a nano sim from AT&T with my number to put into the iPhone 5.
 
Id go to an att store and they will do it all for you on the spot.
They will get the subsidy from his line and then give you a nanosim to put in and use the new iphone 5 on your line.
Take care of all data plan changes etc...
 
Let the man upgrade from his 3GS before it is rendered useless.
I told him to, he refuses.

No, they do it all the time for their customers.
There's nothing wrong or illegal with what you're doing. You're just using someone elses subsidy to get the phone. They dont care who uses the phone, or if you turn around and sell it or burn it right after you get it. As long as you sign the 2 year contract that's all it matter to them.
