You have a one year warranty from Apple. They'll handle a replacement for you.

Umm if the phone is not working, what are you going to do with it till next fall if/when the iPhone5 comes out? Bring it to an Apple Store and they will fix it on the spot. Of course going to an Apple Store this close to Christmas takes a tremendous amount of patience and fortitude... heh...
