Needing Help With Series 4 Watch

I bought a preowned watch and seller said it was unlocked but the screen is damaged so right now im trying to set it up as a new watch so i could verify if its unlocked, its at the screen where it asks you to sync to the watch to the phone, once it finds it, i tried to update the apple watch then it unpairs, so i tried again to sync without updating, it tries to activates then unpairs.

everything ive done is unpairing it. I tried with two phones, one is fully updated and one needs to be updated and nothing else is sucessful.

I think it might be possible that either the watch, or the phone is on the beta program. Or, in fact, it IS actually iCloud locked, and you now own a brick.
