iPod touch negative black visible at all brightness levels?

When we're talking about screens with the "negative black" defect issue, are people seeing it at all brightness levels? Mine w37 shows the negative black much more prominently at max brightness than say.. medium, which is what I normally use..

dude it will always look like crap to me. its unacceptable to have this problem so the only way you should be dealing with it is by returning it for a good one. week 38 or something just don't get a 37

The reason is that Best Buy says it'll be 3-4 weeks until their next shipment, so either return it now and wait until they come in or just keep it..
