Can this be jailbroked out of the box guaranteed? It shouldn't have the 3.1.3 firmware right? Since its second gen I don't need to do a tethered jailbreak right?

Unless it is old stock, real old, I would guess it is a new "MC" version 8GB second gen touch loaded with 3.1.2 and using the new bootROM so will only support a tethered jailbreak.

EDIT: Mind you it is listed as an older model "MB528LL/A"

Hey thanks. This implies to me that 2nd is still being manufactured? I thought all of them would have the OLD bootrom, but perhaps I am incorrect in thinking this.

I just bought an ipod touch 3rd gen and it already had 3.1.3 on it so I have no options. I would be happy with just a 3.1.2 tethered JB, but even that is getting hard to come buy for anything new.
