Actually there's nothing to fix. That's how it works :)
There are things like InputRemapper however that let you remap those keys.

I haven't tried it, but it's supposed to work.

By default shouldn't F8 be F8

not Keyboard backlight?

I am pretty ****ing annoyed by this.
 
When I want to use the F1-F12 keys I have to press the function button first or it (for example ill use f8) turns on the keyboard backlight.

So the fn key is backwards.

How do I fix this so that f8 is f8 and not keyboard backlight (unless I press fn)

prefs/keyboard/check box "Use all F1, . . . ".
 
Glad you got it sorted, just some history..

In the Mac world, function keys have always been pretty unused, so the default behavior of the laptop keys has always been 'hardware function first', Ffun after.
