Nokia VS HTC - microphone

Apparently Nokia and ST co-developed the mic and came to an agreement where Nokia had a 12 month exclusive. ST thought it was only 6 months 
eek.
HTC are blameless but now have to source another mic but don't have to recall any phones already made.
Someone in ST didn't bother to read the paperwork.
