Not Able to download the App Store into my Macbook

I updated my Macbook and still not able to see the APP STORE icon on my dock. I called Apple directly and they said my Macbook is out of warranty. They were asking to give them my credit card information for a $35.00 charge to simply speak with me. I was wondering if anyone here has had the problem of not seeing the App Store icon.

What operating system are you running? Can you find the App Store in Spotlight (CMD + Space)?

No. Unable to find it. I does not download into my macbook. I have a 10.5.8 version

Unfortunately, you have to have at least Snow Leopard in order to be able to install the App Store. This is a paid update.
