A four month old third-party analysis doesn't exactly equate to an answer - though it is a decent read.

I'm pretty sure that Apple won'y start any litigation until the Pre is on the market. I'd guess the documents are ready, but I don't think it makes sense to file until they see the final shipping product. Otherwise, they could be filing against something that isn't even in the final product.
