Petition for a Software Patent free Europe

i just came accross this petition: http://petition.eurolinux.org/index_html?LANG=en.

they want to make a law so you can patent software in Europe. i don't see the point of this, doesn't the user agreement and other things do away with the need for a patent?

also, in Europe it is against the law to patent pure software.

can anyone explain why you would want to patent a piece of software?

I don't know, i thought written work such as code for software was always copyrighted, that would cover the need for a patent
