My badge is showing 2 texts, tried..killing the app, power off/on, hard reset, deleting all my text messages...restored from back up...but my backup had the same issue.

So should I set up as new iPhone...and then am I able to regain my contacts via iCloud?

Have you tried resetting the settings/network settings?

Nada if I set up as new I can get contacts from iCloud as well as photos correct?

Yep. As long as you already have everything set up in iCloud you're good to go.
