Photo recovery from emptied trash?

I used stellar phoenix to restore photos that had been accidentally lost when the trash was emptied. They were found, but I did not save the restore to a drive other than the hard drive. It did say that data would be lost, but I had no other option to select other than 'okay'. Have I lost these photos forever, or is there another way that I can get them back? I have tried to repeat the recovery but had no luck in finding the photos. Can another program help? Thanks for any advice.
