Photos App Issue

This is driving me nuts, I upgraded to Big Sur recently and wanted to fix some minor annoyances with my system so I preformed a clean install and instead of using migration assistant I created a new account.

before doing so I manually made a copy and backed up my Photos Library file as well as creating a current time machine backup.

once I created my account I moved my photos library file over and opened it, everything looked good when it was opened. I had several pictures that needed to be imported (about 800 or so) and as usual imported them via Import All New Items Button. my phone was pulled off the cable while it was importing. then seemed to get stuck. I noticed it saying something about iCloud uploading and I've never enabled this but I think it was auto enabled on the new account when I signed in. so I turned it off (unchecked) and deleted the stored photos in iCloud.

Now I have 286 (New Items) that are already in my library, They have not been changed to JPEG, and they have already been imported now a few times and has created duplicates multiple times. every time I plug my phone in its always the same 269 photos. I tried repairing the photos library multiple times, deleting the photos library, and copying the library back from my nas and re-importing. still the same issue and I can't figure out how to fix it. Can Anyone here give me some additional information to try? I have a lot of old photos and rather not have to start a new Library if possible.
 
Did you solve this? I'm having the same issue. Photos app is showing the same photos as"new", even though they're already been copied.
