It states on the O2 website. under existing iphone customer upgrade and under the old iPhone tab

Don't need 2 iPhones!

We want to make sure you find a good home for your old iPhone once you upgrade. If you've a friend, colleague or family member they can use it as a phone by choosing any of the three options below.

If they're on an existing O2 18-month minimum term contract, they can just transfer onto a Pay Monthly tariff for iPhone*. The end date of their contract will stay the same. Once their tariff has been transferred, they just need to connect to iTunes to activate the iPhone.


So would it be possible to phone o2 and say you have been given an old iphone by a colleague and dont know his last name, they will put you onto a iphone tariff, then you buy a 3G iphone off ebay when they are on (they will be). and use that to activate with your account as an existing customer? if so then you will have a 3G iphone and not be at the beginning of your contract!! If that works then WOO HOO

If they're an O2 business customers, they'll need to move onto a current business tariff with an iPhone Bolt On and will be able to keep their existing contract term*. Once their tariff has been transferred, they just need to connect to iTunes to activate the iPhone. To arrange this they'll need to contact Business Customer Services.

Existing O2 Pay & Go customers can use their current O2 Pay & Go SIM card or new customers can join O2 by getting a free Pay & Go iPhone SIM card from an O2 store. Then add the unlimited Web and Wi-Fi iPhone Bolt On (£10 a month). The only thing that does not work with this option is the Visual Voicemail.




* Tariff migration rules apply.

I thought the same as you and emailed O2 and told it would be £169 to terminate and migrate to a new 18 month iPhone contract!
 
Sounds like a loophole to me.

Of course it may be that the upgrade gets marked on your account so they don't get thousands of people doing just that.. but from what I've seen of O2 they don't seem that organised.
