Apple customers who own faulty Powerbeats 2 devices have begun receiving payouts from a class action lawsuit that Apple settled last year, according to multiple MacRumors readers that have started receiving funds.

Powerbeats 2 owners sued Apple after it was found that some of the headphones had a defect that could cause them to stop working and fail to retain charge after "minimal usage." The plaintiffs in the case alleged that Apple misrepresented the battery life of the Powerbeats 2, and that Apple had said they were sweat and water resistant.

Powerbeats 2 were first released in 2015, and at least some of the failures may have been due to moisture exposure. Apple was also accused of failing to replace or repair defective Powerbeats 2 within the one-year warranty period.

The case did not play out in court as Apple agreed to pay $9.75 million last summer to settle the lawsuit. At the time that it agreed to the payout, Apple said that it denied all allegations and was paying the settlement fee to avoid expensive litigation.

The settlement was approved in January of 2021, and now the money obtained from Apple is being split between all Class Members who submitted claim forms after attorneys' fees and related costs were paid. Anyone who had purchased Powerbeats 2 earbuds before August 2, 2020 were eligible to claim a payment from the settlement.

I was. I went through three replacement pairs of Powerbeats 2 before finally taking the last replacement pair Apple gave me and gifting them to someone who wasn’t likely to sweat as much while wearing them. I loved everything about these headphones except their lack of waterproofing in the control pod that ran along the connecting wire. The issue became moot once Apple did away with that wire and attached pod completely, but it was surprising that Apple couldn’t figure out a solution in the meantime.
 
Need a similar deal for BeatsX which fail due to cable flexing fatigue just at battery node. (This happens well before battery gets tired.)
 
Dang, I didn’t know anything about this. I’m on my third pair, one was a replacement. I guess I’ll see if I can still get in, but probably not since they’re splitting it up. How were customers notified?
 
$114? I signed up. I didn't expect that much.

I went through multiple pairs of those with the warranty. Glad I used Amazon so I was able to have a proof of purchase.
 
Only time I’ve ever gotten a settlement that’s more than what they anticipated. Guess not many people knew about the class action.
 
Apple should include a free 5 year warranty with all their products under which all faults are fixed free of charge with no questions asked. After that you have to pay. That would stop all these class action lawsuits. Most of the money awarded goes to the lawyers anyway.

Well according to the timeline on that linked page, final hearings took place at the end of February. Assuming the various parties came to an agreement at that time, we should see payments begin to go out in another month if they follow the same timeline as that of this case as it was finalized a month earlier in January.

The Batterygate settlement checks are likely to be between $65 and $100, which is a lot more than the expected payout of $25.

Only 2.2 million claims were successfully processed because you needed a valid serial number that was in the claims administrator's database of devices known to be running throttled iOS versions.

There was an appeal in March that delayed the settlement approval, but it appears to have been resolved. Checks will likely be coming before the end of July, and will be significantly higher than the expected $25, based on the number of claims.

I was surprised to see $57 in my PayPal account today, totally forgot about that lawsuit.
