So I spoke to AT&T today about trying to get a different phone due to it being stolen but im still in contract.they discounted my family messaging by 10 dollars so that I can add an extra line and my cost will not increase on my bill but can I just order the iPhone five on Apple's website and just add the line or will it add an extra data plan to my current family plan

It will add an extra data plan, but when you get the phone, don't turn it on.
Go to AT&T and tell them you're doing an upgrade swap. They will give you the new sim for the iPhone 5, and take the data plan off of the new line.

Great so as long as I dont turn it on I wont have to pay for the extra data plan

Yes, but make sure you tell them you want the data removed on that line.
