Purchase iPhone From Friend?

Hi All,

I was considering purchasing a friends iPhone 3G when he gets the iPhone 4 later this month. I am an AT&T customer. Will I be able to put my sim card into the iPhone 3G and start the $15 dollar monthly smartphone data plan without any penalty or restarting my contract?
