I think so long as its not deleted from your computer you should be ok.

If you have deleted it or never had it on there, I'm not sure.

I've had a few refunds for apps. Contact apple here https://expresslane.apple.com/Issues.action I chose quality of purchased content in the other itunes store topics section.

They have often said that the refund is a "one off" and all itunes payments are finals but you can get a refund still.

If you have it on your comp youre good but if its not saved locally then its gone
