Purchasing Question

Since AT&T is completely sold out and I don't feel like waiting 5-10 days for my order fulfillment can I go to Apple to buy and activate the phone, THEN go to AT&T and get a different phone for my wife and set up a family plan? Is that possible to do?

Also... has anyone had trouble with the Availability page on Apple's site? I can't a listing.
