Question about $149 iPhone 3G

My brother is considering updating from his current phone that was subsidized in the past. He currently is able to get a 8GB 3G for 299. Does the subsidy apply to the clearance 16GB unit or does that include a subsidy which requires you to be upgrade eligible?
 
i saw the same thing on my account, it includes the subsidy. so you would have to shell out $349 for the 16gb
