If I dropped my phone and it got a bit scratched could I take it back to apple or exchange it and only have to pay like a restocking fee or something?

No. It's called responsibility. Have some. The scratch isn't due to anything Apple did. They have no reason to exchange it.

They will not let you exchange it for a scratch and may even void your warranty once you open your mouth about it.

Instead, wait for a legitimate issue to come up and exchange it then without mentioning any scratches. Do you have the antenna issue? bingo.

I'm 40. And with that age comes the maturity to not resort to name calling because it was pointed out to me that my question - regardless of who it referenced, was perhaps, silly.
 
besides apple only has a 14 day return policy, check it out. its AT&t that will let you cancel your contract in 30 days
