Question about clearance 16 GB iPhone 3G

My brother is considering updating from his current non iphone that was subsidized in the past. He currently is able to get a 8GB 3G for 299. Is the 149 a non subsidized clearance price for the 16GB unit or does that include a subsidy which requires you to be upgrade eligible?
