Im thinking of resetting m iphone 4s to factory settings in order to take it to the apple store... If they run a diagnostic on the phone can they tell if the device was previously jb?! Please help thank you...

Woulda answered the same way..He said it best. They're in the dark on that one...

If I restore using the backup they can find out? because If I set it up as a new phone Im going to lose my pictures and videos.

Yep. So take it in blank, get your replacement, then sync your replacement from the backup. You just won't have your contacts and pics til your new phone is there.
