Hi,
If I purchase an iphone from someone who got the phone as a replacement phone from apple and didn't activate it, or if I purchase a new iphone directly from apple....

Can I use either of these an an ipod and not need to activate cellular service. My goal is to just use it without cellular service

Sure can. You may need to pop in an old SIM card or set it up via WiFi. I use a SE as an iPod touch with no service. Just use it on WiFi.
