Well, I sat in line today at my local Apple store today for 3 hours only to be told they were out of 16GBs when I finally reached the counter. I ended up buying an 8GB. Will Apple let me pay the restocking fee and upgrade to the 16GB within 14 days for the subsidized price? If not, any other suggestions in how to trade up? Ebay, etc..?!

I was wondering the same thing, also.
I was in the same situation where after waiting in line they were out of 16GB.

Anyone care to chime in?

If I end up REALLY wanting the 16GB, and Apple won't let me trade up within 14 days, can I sell my existing 8GB on ebay and buy a 16GB at the $499 price point? Is this allowed?

If you didnt want the 8g why did you buy it?

I am only asking in order to see if it would be a painless upgrade to the 16 within 14 days. If it doesn't work out i'll just live with the 8 and pick up a 32GB next year.. :D

...and I waited in line for 3 Hours and didn't want to leave empty handed.
