Question regardinng a used Iphone 3GS and current AT&T plan

Hi, I am currently on AT&T's PDA data plan with a Nokia N97. I had an original Iphone when it was released. My brother and I would like to swap phones. I want to do this, but I'm afraid I will be connected to a contract and lose my eligibility to purchase the fourth generation Iphone. Does anyone have any experience with this? Should I just jailbreak the phone?

You can switch out phones with no problems. If you have issues with data call at&t to have them add the iphone data plan. You will still have full upgrade and discount eligibility.
