Recent folder list on dock

I created a smart folder in Finder called recents with the search criteria being kind, folder, last opened date, within last 30 days. Added it to the dock and I have a nice list of all my recently opened folders. Problem is when I open one from that list it removes itself. It stays in the list in finder on the sidebar but disappears from the list on the dock.

Is this a bug or is my search criteria wrong?
